Update 2: A friend of mine recognised another affected artist among the prints. We have already contacted her regarding the situation.

Update 1: Dark Inc [link] took my prints down from their online store.

Do you remember this andreja.deviantart.com/art/ART-THEFT-272475529 and www.flickr.com/photos/27120677@N04/6459189071/ ? Yep it is still not over. Same guy, same thing as last time. All I am asking from people is to keep an eye open and let me know if you find these prints being sold anywhere else such as shops, shopping malls, events etc.

I was told that:

- Prints are still being sold through offline events/shops such as Hardcore 101 and the 4th Ave winter street fair.

- I keep getting reports from people living near Chula Vista who saw the prints being sold in various locations.

- Another shop who is selling them is Left Coast Threads in San Diego.

- edit the website removed the prints in question

they are still using your art and havent taken it down from their site and are still selling it. a friend of mine had shown it to me the other day saying they were thinking about buying it.

In the link below there is a print that looks very much alike one of the prints above (row 2 x 3 colonel). Thanks to Keletane 's link, www.deviantart.com/art/doll-gi…, the tattoo artist wrote three days ago where (s)he had got this print from, and it was from a company called Digoil Renowned which you're familiar with. In hope of you retrieving your rights as an artist, I'm hoping this will help stop the art theft slightly! They are still selling one of the prints.

Looks like on April 6th Digoil Canvas Art posted a picture of their retail wall on facebook, and your images are smack dab in the middle.

welcome to the world of art! if you are good at it, it will be sold, and probably not by you in most cases! even major corps with lawyers on call 24/7 cant stop it so good luck! visit Mexico, Russia, and most other countries and you can buy "Air Jardans" and "Guccii" and "Roll ex". you're lucky if they even change up the spelling of the name like those three I have seen. its like the war on marijuana(chasing after that weed), stolen work and ideas pops up everywhere!!!!

i happened to stumble upon this while browsing the "digital art" section here on devientart and i was compelled to at least leave my 2 cents... i have been a graphic designer for about 6 years and this has always been a controversial subject... as far as i knew copyright law says that anything changed up 30% of its original can become your own... i have looked through your gallery and you are an amazingly talented artist and photographer, able to capture and create a style and scene from scratch... i also looked through his work and having over 6 years worth of large format digital printing and graphic design experience, i can say, he is also an extremely talented artist capable of doing the same as you but in a computer application that was designed to do just that... in order for him to be printing high quality prints of that image, he had to recreate it himself (unless you were 'sharing' a very high resolution file), which can take hours on end of digital painting and color adjusting, not just your image but every other aspect included in the making of his artwork... it pains me to see so much ignorance over digital manipulations... all artist use reference of some sort... in most cases graphic designers piece together many different pieces of many images to make there artwork... if that's wrong then why is someone like andy warhol so famous...? take a look at the history of art and ask yourself where all the inspiration came from...? im sure you have been inspired by another artist in you life as well, trying to mimic, recreate and learn from there style... the only difference i see is you are creating an object with "real life" tools and materials and he is doing the same, but digitally... please understand i am not taking sides... in my eyes you are both amazingly talented artists... if i where in his shoes i would've asked first before trying to sell or at least offer something to you as compensation... keep in mind, creativity is evolution and without taking an idea and trying to improve it in your own way, we could never evolve... i am sorry your upset but remember we are 'sharing' our art with the world here...

Copyright Myths:

- If I change someone else’s work I can claim it as my own.
The act of copying or adapting someone else’s work is a breach of copyright. Also any adaptation will be legally regarded as a derived work; so if you simply adapt the work of others, it will still be their work, and they have every right to object, (and are also entitled to any money you make from their work).
The only safe option is to create something that is not copied or adapted from the work of others.
There is nothing to stop you being inspired by the work of others, but when it comes to your own work, start with a blank sheet and do not try to copy what others have done.

- I can legally copy 10% without it being infringement.
That's another myth that originated from the 'fair use' guidelines. Unless it is explicitly allowed under fair use or fair dealing rules, any unauthorised use of copyright work can potentially lead to legal action. In cases that have come to trial what is clear is that it is the perceived importance of the copied content rather than simply the quantity that counts.

- Everything on the Internet ‘public domain’ and free to use.
This highlights a common misunderstanding about what is meant by ‘public domain’ when referring to copyright work.
A work will fall into the public domain once copyright expires, this will typically be many years after the author’s death.
While work published on the Internet may be publicly accessible, it is certainly not in the public domain.

i'm not arguing but for the sake of debate, what is art...? is the empire state building art...? is a club remix of an old song art...? is a person art...? is a doll art...? is a photo art...? if i am able to sit in front of my favorite sculpture in the park and paint it and later sell it in my gallery then why isn't ok to paint an image i find online... in this case it seems to me like your photo was used as reference... he didn't take your image, blow it up and sell it... he repainted and redesign an image based on the imagery found in your photo... i'm not sure if your familiar with the process but there is no "make it cool" button in photoshop... it takes a lot of knowledge, experience, time, patients and skill to pull something like that off... i'm sure u can appreciate that... i dont know all of the circumstances surrounding this instance but there is an ongoing debate and many open cases on this topic... art is not always made from "blank paper"... if it was there would be no evolution of it... me myself am not the type of person to use other peoples 'resources' without permission, so in that case i can respect your concern, but as design piece, it is not the same as your photograph... similar, but not the same and definitely not your original photo... what exactly did u have copyrighted, the image, doll, logo...?

"it seems to me like your photo was used as reference" He removed the watermark and then used my original photo as if it was a stock image. He did the same using other artists works such as Sylvia Ji (sylviaji.com).

You might believe he has done nothing wrong, and fair enough, everyone is free to have his own opinion. But the law is clearly written, the copyright infringement is there and this is the whole point of the issue.

if copyright was actually infringed, then that is wrong. i dont disagree with that. as i said, personally i would have requested permission to use your image if it was ment to be sold... my point was, it looks like he did more than simply place your image strategically in his design and to be able to print an image 'high quality' at the size displayed in the image of his work, he would have to 'redesign' your image... unless you had a high resolution image available for anyone to use... canvas prints are printed anywhere between 300 and 1400 dpi so a 'standard' or 'web sized' file couldnt be reprinted at that size without being enhanced greatly... lets say that print is 12"x24", if its printed at 300 dpi, thats 3600px x 7200px and at 1400dpi its 16,800px x 33,600px and there are very few people on deviantart that will freely put such large files out there to be 'played with'.. i am truely amazed by your work and i think you are an amazing artist and i'd hate to see him dismissed as a great artist without giving him the benefit of the doubt... i dont know the whole story but if this is his M.O., then fair enough, he's going about it the wrong way and should be confronted, but it may be more than it seems...

I already got in touch with them and they have stopped selling the prints. They are victims as well since they paid for prints that they thought were made by the "artist".

That's fucked up. I personally would beat that person to a bloody pulp if they were selling my photographs. That's just me though. Still, I will keep a lookout for these if I see them anywhere.

I saw some of these prints being sold in San Diego's Kobey's Swap Meet near the sports arena. Next time I go I'll make sure to see what shop (tent? idk what you can call those.) it is. That's not right. Makes me sick to know that there are people like this. >:C
